그리고 그는 소 제기 기간이 경과한 후에 특허출원인변경신고를 했다.

If so, the lawsuit for the cancellation is not legal.

그렇다면 해당 취소의 소는 적법하지 않다.

False trademark registration

상표등록 허위표시

Anyone who displays a trademark for which a trademark has not been registered in a commercial advertisement as if it is a registered trademark shall be punished by imprisonment for not more than 3 years or a fine not exceeding 20 million won.

상표등록을 하지 아니한 상표를 등록상표인 것같이 영업용 광고에 표시한 자는 3년이하의 징역 또는 2천만원 이하의 벌금에 처한다.

The trial for invalidation of correction may be requested during the existence of the patent right as well as after the expiration of the patent right as long as the correction trial decision is finalized.

정정무효심판은 정정심결이 확정된 이후이면 특허권의 존속 중에는 물론 특허권의 소멸 후에도 청구할 수 있다.
