행정법상 법령은 지역적으로 대한민국의 영토전역에 걸쳐 효력을 가지는 것이 원칙이다.

아울러 일반국민의 이해에 직접 관계가 없는 경우 등 특별한 사정이 있는 경우라면 법령의 소급적용이 허용된다.

특히 인ㆍ허가신청 후 처분 전에 관계법령이 개정 시행된 경우, 행정행위는 인허가 처분 시에 시행중인 법령과 허가기준에 의하여 하는 것이 원칙이다.
